1.Validity
These General Terms and Conditions apply to all orders.
2.Offers and contract conclusion
All offers are non-binding. Orders are only considered accepted if they have been confirmed by us in writing. The acceptance of an order does not oblige us to accept follow-up orders at the same conditions. A valid contract is only concluded after we have checked and approved it.
3. Prices
The prices are in the currency indicated on the valid price list / offer, plus VAT. Our price lists are indicative prices for resale by the trade without any price fixing. We reserve the right to change prices at any time.
4. Delivery conditions
Free deliveries are made from the net value of goods (less special costs) of € 600.00 throughout Europe, if a valid EORI-Nr. is available. Free deliveries are made from the net value of goods (less special costs) of CHF 750.00 domestic (Switzerland and Liechtenstein). CHF 750.00 With a net value of goods of less than € 600.00 / CHF 750.00, we charge freight costs at cost. For partial deliveries on customer request, the additional transport costs will be charged.
5. Delivery time
As a rule, we deliver all articles in our catalog from stock or within a few days. Otherwise we will inform you about the expected delivery time according to the employment situation. If the order volume changes, the delivery time will change accordingly. For special versions, the delivery date will be announced after the printing or drawing approval.
6. Delivery on call
In the case of order-related and / or customer-specific manufactured products, the entire order quantity is due for delivery on the due date, delivered and invoiced.
7. Liability for defects
The inspection and complaint obligations according to the Swiss Code of Obligations Art. 201ff apply, whereby you report recognizable defects within 3 days after delivery. Not immediately recognizable defects are to be reported at the latest 1 year after delivery (OR Art. 210) and within 3 days after detection. The supplier obligations / rights according to OR Art. 205 ff apply (conversion, reduction, replacement).
8. Transport and transport liability
Our goods are carefully packed and must be checked immediately upon arrival. In case of any damage caused by transport, Kunststoffwerk AG must be informed within 3 days. With the transfer of risk, the purchase contract is considered fulfilled. The place of delivery corresponds to the valid Incoterms (EXW, DDP, DAP etc.)
9. Special designs
For custom-made items, we reserve the right to over- or under-deliveries of up to 10%. Orders for special items can not be withdrawn. This also applies to mass-produced articles, if they have been ordered with a special mark or a special inscription.
10. Individually designed goods
You provide us with the appropriate printing data required for the individual design of the goods. We reserve the right to invoice you for unusually high special expenses for creating and / or adapting suitable print data.
11. Terms of payment
30 days net, unless otherwise agreed.
12. Retention of title
The delivered goods remain property of Kunststoffwerk AG until full payment.
13. Privacy
Kunststoffwerk AG treats the customer data, which is stored as part of the order processing, confidentially. The treatment of the data is in accordance with the Data Protection Act. Kunststoffwerk AG undertakes not to make any personal customer data available to third parties without prior agreement.
14. Force majeure
Events of force majeure, entitle us to suspend the delivery for the duration of the hindrance and a reasonable start-up period or to withdraw from the contract in whole or in part according to their effects. If delivery is delayed by more than 3 months due to the effects of force majeure, the buyer is entitled to withdraw from the affected part of the delivery. Force majeure events shall include, but are not limited to, all actions, in particular forces of nature, war, laws, official interventions, seizure, export, import or transit bans, payment restrictions, raw material failure, energy loss, machine failure, etc. beyond our control lie.

Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
16. Jurisdiction
